Terms and Conditions

 
1. MEMBERSHIP

1.1 Tan Chong International Limited (“TCIL”) reserves the right to reject any application for membership. If an application for membership is rejected, then any benefit that may have been accrued by the applicant will be null and void.

1.2 Continued participation in the programme by a member will be regarded as acceptance of the current Terms and Conditions.

1.3 In order to maintain DUO membership, TCIL needs to keep personal data on each member. Some of this data may be shared with subsidiaries and other companies in the programme. This data may also be used for marketing and communication purposes by the same companies.

1.4 DUO membership accounts are not transferrable. Enrolment of several people in a single account (joint account) and multiple enrolments by a single person is strictly not allowed.

1.5 A name change on the member’s record will be accepted upon written notification to TCIL using the Change of Name Form. Proof of name change is required. Members can update their personal details e.g. mailing address or email address online at www.duo.com.sg

1.6 Membership will end automatically upon the death of the member. DUO Dollars earned but not redeemed at the time of death, as well as benefits and privileges, will be automatically cancelled.

1.7 TCIL reserves the right to audit any account at any time for compliance with the programme’s Terms and Conditions without prior notice being given.

2. EARNING DUO DOLLARS

2.1 Members will be awarded 1 DUO Dollar for every retail dollar spent within TCIL group of companies in Singapore. For credit customers (except New Vehicle customers), DUO Dollars will only be credited upon full payment.

2.2 DUO Dollars earned may only be redeemed by the member for rewards under the DUO programme.

2.3 DUO Dollars may be used as soon as they have been credited to member’s accounts.

2.4 DUO Dollars are non-transferrable.

2.5 Members should allow four weeks for DUO Dollars earned from TCIL to be credited into account before raising a claim for missing DUO Dollars.

2.6 DUO Dollars are valid for a period two years, starting from the date the DUO Dollars are being credited to the registered DUO member’s account. A member’s DUO Dollars will expire after two years at the end of the equivalent month in which they were earned. For example, DUO Dollars credited to a member’s DUO account in July 2010 will expire on 31st July 2012. Any DUO Dollars not utilized by the expiry date will be forfeited.

2.7 DUO Dollars that have expired cannot be reinstated.

2.8 TCIL reserves the rights to revoke, deduct and/or recompute any DUO Dollars for any reason as TCIL may deem fit at its discretion.

2.9 TCL shall not be liable for the loss of any DUO Dollars due to any error or mistake made by the Member in the input of information when signing up for membership or at any time thereafter.

3. PASSWORD

3.1 Members shall keep their password confidential at all times and undertake not to divulge the password to any other person under any circumstances whatsoever and shall not permit any unauthorised person to use their password.

3.2 TCIL is under no obligation or duty to verify the identity of any person performing any authorised transaction through the use of a valid password. Members shall be liable for all transactions made with the use of a valid password, whether it is with or without the member’s knowledge or consent.

3.3 TCIL shall not be held liable for any loss, damage or expense incurred by the member however caused through any unauthorised disclosure or unauthorised use of their password.

4. REWARDS & PRIVILEGES THROUGH DUO WEBSITE

4.1 Rewards and privileges can be redeemed through the DUO website (www.duo.com.sg)

4.2 DUO Dollars must be valid when redemption for rewards/privileges is made. Members must ensure that they have sufficient DUO Dollars in their accounts before redemption.

4.3 Members must report may unauthorized redemptions from their DUO account within three months of the unauthorized transaction activity for any corrective action to be possible.

4.4 Member’s use of the rewards/privileges is subject to the Terms and Conditions set by both TCIL and the providing DUO programme partners or participating organizations (hereinafter called ‘Merchant’).

4.5 All redemption requests are subject to the availability of the rewards and provided that the Member has sufficient DUO Dollars for the rewards requested.

4.6 DUO Dollars redeemed or purported to be redeemed cannot be refunded or transferred back to the DUO account.

4.7 Cancellation of redemption request by the member will not be accepted once the redemption has been made.

4.8 DUO redemptions and vouchers will cease to be valid after the date of expiry indicated. There shall be no extension of dates.

5. ELIGIBILITY

5.1 The rights of the Member to redeem the rewards shall be automatically forfeited if the DUO account is suspended and/or terminated.

6. REDEMPTION OF DUO REWARDS AND PRIVILEGES

6.1 Voucher(s) are neither refundable nor exchangeable for cash. Unused balances will not be refunded.

6.2 Voucher(s) are only acceptable for use at DUO’s participating Merchant outlets.

6.3 Voucher(s) can be used in conjunction with Maybank t’reats discounts and privileges at selected Merchant outlets unless otherwise stated.

6.4 Discounts, if any, shall only apply to the balance amount of the bill after the total value of the voucher(s) is deducted.

6.5 Redemption of voucher(s) is subjected to the Terms and Conditions imposed by DUO’s participating Merchant’s outlet.

6.6 The voucher(s) will be sent to the member’s mailing address.

6.7 Voucher(s) must be presented in person during payment/redemption, accompanied by NRIC/passport or authorization letter.

6.8 For corporate members, voucher(s) must be presented by a representative from the company and accompanied by the company’s authorisation letter (with the company stamp and authorised signature) and the representative’s identification card/passport.

6.9 Issuance of voucher(s) does not constitute any reservation on products/services at any participating Merchant’s outlet. Member are responsible for making all reservations/notifications and enquiries of availability of the products/services pertaining to the voucher he/she is going to redeem.

6.10 Voucher(s) must be redeemed on or before the date of expiration indicated, on the voucher(s). Extension of expired vouchers is strictly prohibited.

6.11 Lost, misplaced or damaged redemption letter(s) and/or voucher(s) will not be replaced.

6.12 TCIL is not obliged to replace any lost, defaced, damaged or stolen voucher(s).

6.13 TCIL reserves the right to charge the member accordingly should the lost voucher be found and utilised by the member.

7. GENERAL TERMS FOR DUO REWARDS PROGRAMME

7.1 DUO Rewards & Privileges are subject to availability and are redeemable on a first-come, first-served basis. TCIL reserves the right in its absolute discretion to cancel, change, substitute or remove the rewards/privileges or make any amendments to, change or substitute the conditions relating to the rewards at any time with or without prior notice to the DUO member.

7.2 Items redeemed cannot be returned or exchange for other rewards and are not refundable for cash/DUO Dollars under any circumstance whatsoever. Without prejudice to aforesaid, if TCIL, in its sole discretion agrees to allow any of the foregoing, TCIL shall be entitled to charge the member such fees as TCIL deems fit.

7.3 Merchants are not obliged to reserve stock or goods for DUO members and neither TCIL nor its Merchants shall be liable or responsible in the event of any shortage.

7.4 Redemptions can only be made within the redemption hours indicated (a) On the redemption letter/voucher(s), (b) by TCIL or (c) by the Merchants at their respective outlets. Members shall adhere to the stipulated redemption hours, failing which; redemption(s) shall not be entertained.

7.5 Redemption of DUO rewards/privileges shall be, subjected to the individual Merchants and/or TCIL’s group of companies’ terms and conditions.

7.6 Members are advised to examine all rewards/privileges upon collection and to reject any damaged or defective goods immediately at the Merchant’s outlet or any other venue at which the redemption is made. No return of goods will be accepted once the Member has left the Merchant’s premises or at any other place where the redemption is made.

7.7 In the event of any defects or damage in goods, the Member shall contact and liaise directly with the Merchant or the manufacturer. For avoidance of doubt, TCIL shall not be liable to the member in any way for any such event.

7.8 Any disputes concerning any rewards/privileges redeemed or collected shall be between the Member and the Merchant or manufacturer. TCIL shall not be liable or involved in such disputes.

7.9 In the course of maintaining the DUO membership, TCIL will keep the personal data and information provided to them by each Member. By applying for and maintaining a DUO membership, members agree and accept that this information and data will be shared with TCIL subsidiaries and other companies in this programme and may be used for marketing and communication purposes by these companies and the member may be contacted by these companies for these purposes.

8. GENERAL TERMS & CONDITIONS

8.1 TCIL reserves the rights, at any time and without prior notice, to delete, add or modify any of these terms and conditions, or to terminate any (or all) of the programmes mentioned herein.

8.2 TCIL may change the programme rules of programme benefits without prior notice, even though such changes may affect the value of DUO Dollars already accumulated. TCIL reserves the right at any time to change any such programme rules of programme benefits without limitation to the following:
     a) DUO programme partners or participating organizations (Merchant)
     b) The rules for earning or redeeming DUO Dollars
     c) The rewards/privileges structure and the availability of rewards/privileges
     d) The rules for redemptions in Singapore.
     e) The features of special offers and promotions. Rewards/privileges from programme partners are dependent on the partner’s continued participation in the DUO programme.


8.3 TCIL reserves the right to terminate the programme or any part thereof, at any time with or without notice, even though termination may affect the member’s right to accumulate DUO Dollars. TCIL is not liable to members for any loss of value or benefits that may arise as a result of any changes made to the programme.

8.4 TCIL shall not be liable for any product or service offered or promised from a participating Merchant. TCIL shall not be held liable for any action that may arise as a result of using a participating Merchant.

8.5 TCIL may assign or deal with these Terms and Conditions in favour of any of its subsidiaries, sub-contractors or appointed agents to carry out any of its obligations herein. TCIL shall not be responsible to the member for any delay in performance of non-performance of its sub-contractors and/or agents due to cause beyond reasonable control.

8.6 TCIL shall not be in breach of any obligation of confidentiality if disclosure of a member’s confidential information is pursued in conjunction with an order of court, or is required by law or any governmental or regulatory authority. Further, TCIL is not obliged to give the members prior notice of such disclosure.

8.7 Any DUO Dollars credited to a member’s account that are found to be ineligible will be deducted automatically. Documents submitted for claims (to prove eligibility) cannot be returned.

8.8 Members are fully responsible for keeping themselves informed of the Terms and Conditions of the DUO programme which are posted on the DUO website (http://www.duo.com.sg).

8.9 It is the responsibility of the members to keep their mailing address and email address up to date. Any communication sent to members will be regarded as delivered when posted to a mailing address on record. TCIL will not be responsible for any delayed, misdirected or lost mail. Any changes to the member’s mailing address must be updated online.

8.10 TCIL reserves the right to interpret, apply and communicate the Terms and Conditions as posted on the DUO website. All decisions made by Tan Chong International shall be final and conclusive in each case.

8.11 TCIL shall not be liable for any claims, expenses, loss or damage incurred by the member or any party arising from or in connection with any incorrect DUO Dollars being awarded to the member’s account in accordance with the terms and conditions stated herein, in respect to any transaction.

8.12 TCIL shall be entitled to send any notice (by form of post or electronic mailers) to member’s last known address with TCIL. The member agrees that any notices sent by TCIL in such manners shall be deemed received by the DUO members after 7 days from the date of the posting.

8.13 No forbearance, delay of failure on our part to exercise any power or right under these terms and conditions shall operate as a waiver of such power or right, nor shall any single or partial exercise of such power or right preclude any further exercise of that or any power or right.

8.14 These terms and conditions are governed by and construed in accordance with the laws of the Republic of Singapore. All DUO members submit themselves to the exclusive jurisdiction of the courts of Singapore.

8.15 All information contained herein is correct and current at the time of publication and is subjected to change.
